To maintain eligibility for SNAP benefits for more than three months in the 36-month period that started January 1, 2019, an ABAWD must complete and document participation in one of the following each month:

  • Work for at least 80 hours per month
  • Participate in a qualifying work/training program approved by the social services district for at least 80 hours per month
  • Comply with a Work Experience Program assignment for the number of hours per month equal to the SNAP grant divided by the higher of the federal or State minimum wage.
  • Participate in an employment and training program for veterans operated by the Department of Labor or the Department of Veteranââ¬â¢s Affairs for at least 80 hours per month.
  • Participate in a program under the Workforce Innovation and Opportunity Act or Trade Act which may include job search, job readiness, occupational skills training and education activities for at least 80 hours a month or
  • Participate in a combination of work or qualifying work programs for at least 80 hours a month.

Note: New York State is currently operating under a federal waiver of the ABAWD time limit in all areas of the State for the period October 1, 2020 through September 30, 2022 so no ABAWD is subject to the time limit requirement during this period.

When Will Benefits Be Available For A Reinstated Case

For a reinstated case, benefits will be available based on the table below:

How To Appeal A Food Stamps Decision

To appeal a SNAP decision after you have been denied food stamps, you will need to request a fair hearing with your states health and human services department. You can visit your local food stamp office to appeal a decision or contact your states food stamp department by dialing the SNAP hotline at 800.221.5689 and requesting a fair hearing today.

A state hearing request can be made in person, in writing, or by calling your states health and human services department. That being said you are encouraged to either send an EBT appeal letter or write down the date and time that you call to challenge a denied food stamp application.

Information Needed For Eligibility

Whether you are applying for the first time, or renewing your benefits, you may need one or more of the following pieces of information to determine whether you are eligible:

  • Proof of citizenship and identity for everyone who is applying for benefits.
  • Alien Registration Cards, if there are non-U.S. citizens applying for benefits in your household.
  • Social Security numbers for everyone, or proof that a Social Security number has been applied for.
  • Proof of relationship, birth certificates may be used
  • Name, address & daytime phone number of landlord or neighbor.
  • A statement verifying your address and the names of everyone living with you. The statement must be made by a non-relative who doesnt live with you. It must be signed, dated and include that personâs address and telephone number.
  • Proof of ALL money your household received from any source last month and this month.
  • Proof that your employment ended and last date paid.
  • Bank or credit union complete statement for the most recent month.
  • Proof of savings bonds, securities, retirement plans and life insurance.
  • Proof of rent/mortgage and utility bills for the most recent month.
  • Proof of child care expenses for the most recent month.
  • Proof of all medical expenses for those applying for benefits who are age 60 or older or receive disability benefits.

If you are changing jobs, getting a raise or something else in your life is about to change that could affect your eligibility, its best to report those changes as soon as possible. Timely reporting can keep you from being penalized. You might be ruled ineligible to receive SNAP at that time, but not having to wait out a disqualification period means that if your situation changes at any time, you can immediately reapply.
