Renaming The Food Stamp Program

The 2008 farm bill renamed the Food Stamp Program to the Supplemental Nutrition Assistance Program and replaced all references to “stamp” or “coupon” in federal law with “card” or “EBT.” This was done to mark a more explicit focus on providing nutrition. It was also done to reduce usage of the stigmatized phrase “food stamps”.

Why Is New York Required To Implement Able Bodied Adults Without Dependents Requirements

ABAWD rules are required by the federal government. Social services districts that do not qualify for county based ABAWD waivers are required to implement ABAWD work requirements.

New York State is currently operating under a federal waiver of the ABAWD time limit in all areas of the State for the period October 1, 2020 through September 30, 2023 so no ABAWD is subject to the time limit requirement during this period.

Penalty For Transferring Assets

You are not able to give away your assets just to qualify for food assistance, nor can you sell things for much less than they are worth to try to qualify.

Giving away assets or selling them for less than fair market value is considered a transfer of assets. If you or any household member transfers assets within 90 days before applying for food assistance for the purpose of qualifying for benefits, you will not be able to receive food assistance benefits for up to one year.

The following transfers do not affect eligibility:

• Assets that would not otherwise affect eligibility
• Assets that are sold or traded at, or near, fair market value
• Assets transferred between members of the same household
• Assets transferred for reasons other than attempting to qualify for food assistance benefits.

What Is An Abawd Required To Do

To maintain eligibility for SNAP benefits for more than three months in the 36-month period that started January 1, 2022, an ABAWD must complete and document participation in one of the following each month:

• Work for at least 80 hours per month
• Participate in a qualifying work/training program approved by the social services district for at least 80 hours per month
• Comply with a Work Experience Program assignment for the number of hours per month equal to the SNAP grant divided by the higher of the federal or State minimum wage
• Participate in an employment and training program for veterans operated by the Department of Labor or the Department of Veterans Affairs for at least 80 hours per month
• Participate in a program under the Workforce Innovation and Opportunity Act or Trade Act which may include job search, job readiness, occupational skills training and education activities for at least 80 hours per month or
• Participate in a combination of work or qualifying work programs for at least 80 hours per month.

States Encouraged To Call Food Stamps Snap

To fight the stigma around the supplemental food nutrition program in 2008 the Food Stamp Act of 1977, that is the basis of the modern-day program, was changed to the Food and Nutrition Act of 2008. the Supplemental Nutrition Assistance Program or SNAP. States were encouraged to change their program’s name to SNAP or another alternate name but they still maintain the flexibility of what to call their own program.

Foods You Can Buy With Food Assistance

Households can use food assistance benefits to buy:

• Breads and cereals
• Seeds and plants to grow and produce food for the household to eat.

Households cannot use food assistance benefits to buy:

• Beer, wine, liquor, cigarettes, or tobacco
• Pet food, soaps, paper products, or household supplies
• Vitamins and other medicines

What Are Deductions And How Do They Affect Snap Eligibility

There are seven allowable deductions that you can consider when determining your net pay. To figure out your net income, you have to figure out which allowable deductions apply to your situations and deduct them from your gross income. The difference is your net income.

Each state outlines employment requirements as part of SNAP eligibility. These requirements include:

• Registering for work – some states will require you to provide proof that you are actively applying for work on a weekly basis.
• Not voluntarily quitting your job If you are unemployed, you need to prove that it was not your choice.
• Not purposely reducing your hours If your hours are cut making you income eligible, you will need to prove that the cut in hours was beyond your control.
• Taking a job if offered
• Participating in state-offered employment and training programs.

SNAP benefits will be discontinued if any of these employment requirements are not followed. There are people exempt from the employment requirements. This includes children, seniors, pregnant women, and individuals that are exempt from working for health reasons.

Employment requirements apply to applicants determined to be Able-Bodied Adults without Dependents . Under the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, ABAWDs are limited to 3 months of SNAP benefits over a 36-month period unless they are doing at least one of the following:

History Of Food Stamps

Food stamps were introduced in 1939 to assist citizens who were receiving aid from the government to afford foods at a lower cost. Residents that met the food stamps eligibility criteria could purchase orange stamps that were equivalent to their normal food expenditures. With every $1 orange stamp purchase, they could receive 50 cents worth of a blue stamp. Blue stamps were used to purchase foods that were in surplus according to the U.S. Department of Agriculture . Americans could no longer apply for food stamps once the food surplus ended.

A permanent food stamps program was enacted in 1964. Its purpose was to improve the nutrition of undernourished low-income families and support the agricultural economy. This act brought pilot food assistance programs under Congressional control and enforced regulations and limits on foods that participants could purchase. In order to receive nutrition assistance, eligible citizens were still required to purchase their physical stamps. In addition, the program was still not implemented nationwide. It would not reach citizens in all U.S. states until 1974.

Numerous other food stamp provisions were enacted between 1977 and today, altering the program and expanding its benefits. For instance, the Food and Agriculture Act of 1977:

• Established income guidelines at the poverty level.
• Penalized households in which the head earner voluntarily quit jobs.
• Raised resource limits.
• Established standard calculations for income deductions.

Information About Applying For The Wic And Snap Programs

Before applying for the WIC and SNAP programs, you must determine which department administers these programs in your state. These benefits may be issued through your department of social services or family services. Once you know which department provides WIC and SNAP benefits, you can submit a SNAP application. If you are a low-income pregnant woman that is accepted into SNAP, you will automatically be eligible for the WIC program.

The application for SNAP can generally be completed online, in person or by mail depending on your state. You will need to contact the appropriate state agency to find out more information. Welfare Reform And Subsequent Amendments

The mid-1990s was a period of welfare reform. Prior to 1996, the rules for the cash welfare program, Aid to Families with Dependent Children , were waived for many states. With the enactment of the 1996 welfare reform act, called the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 , AFDC, an entitlement program, was replaced that with a new block grant to states called Temporary Assistance to Needy Families TANF.

Although the Food Stamp Program was reauthorized in the 1996 Farm Bill, the 1996 welfare reform made several changes to the program, including:

• denying eligibility for food stamps to most legal immigrants who had been in the country less than five years
• placing a time limit on food stamp receipt of three out of 36 months for Able-bodied Adults Without Dependents who are not working at least 20 hours a week or participating in a work program
• reducing the maximum allotments to 100 percent of the change in the Thrifty Food Plan from 103 percent of the change in the TFP
• freezing the standard deduction, the vehicle limit, and the minimum benefit
• setting the shelter cap at graduated specified levels up to $300 by fiscal year 2001, and allowing states to mandate the use of the standard utility allowance
• revising provisions for disqualification, including comparable disqualification with other means-tested programs and
• requiring states to implement EBT before October 1, 2002.

Recent Changes To Snap Benefits And Eligibility

Congress and the U.S. Department of Agriculture have temporarily modified SNAP eligibility and benefits in response to the COVID-19 pandemic. The changes that remain in effect as of October 2021 are described below.

Separately, in August 2021 USDA announced a revision of the Thrifty Food Plan , which raised SNAP benefit levels beginning in October 2021 .

If You Receive Snap Overpayments

There are three different kinds of SNAP overpayments:

If DCF claims that your household received more food stamps than you should have been given but you believe that you were not overpaid, you have the right to appeal the decision within ninety days.

If you were overpaid benefits, you are still obligated to pay back DCF for the amount of overpayment even if the overpayment was DCFs error. An accidental overpayment does not benefit your household, because it must always be paid back. If you have noticed an overpayment in your SNAP benefits that you believe to be DCFs error, notify them immediately. It cannot benefit you in the long run.

If you do not appeal or if you agree with the overpayment, DCF can do several things to collect the amount that you owe:

• If you are getting SNAP benefits now, DCF will lower your monthly benefits. The amount they will take depends on the type of overpayment you have.
• If you are not getting SNAP benefits, DCF will try to get you to agree to a repayment plan. If you do not agree, they can take your federal tax refund. In some situations, they can also take part of other benefits you get, like Social Security.

A recent administrative action has permanently increased benefits for the Supplemental Nutrition Assistance Program by 25 percent. Unfortunately, this historic boost fails to address the structural problems that plague this nearly 60-year-old program.

The official Supplemental Nutrition Assistance Program webpage proudly proclaims that, SNAP provides nutrition benefits to supplement the food budget of needy families so they can purchase healthy food

To that admirable end, the program formerly known as food stamps distributed$79 billion to 40 million people last year. Yet this desire to provide wholesome food to needy families conflicts with clear evidence that wholesome food is not what they think they need. Whether they play by the rules or not, people receiving SNAP benefits currently spend between 70-100 percent of that benefit on things other than healthy food.

Governmentresearchers determined that average SNAP recipients increase their food expenditure by only 30 percent of the value of their benefits. In other words, a person previously spending $300 on food a month who qualifies for $100 of food stamp benefits will start spending $330 on food and shift the $70 from his existing budget to other purposes. This surprisingly low percentage suggests that food is not recipients top priority, as people who were in dire need of food would be expected to boost their food budget by the full value of the benefits.

Pilot Food Stamp Program

The 18 years between the end of the first FSP and the inception of the next were filled with studies, reports, and legislative proposals. Prominent US senators actively associated with attempts to enact a food stamp program during this period included George Aiken, Robert M. La Follette Jr., Hubert Humphrey, Estes Kefauver, and Stuart Symington. From 1954 on, US RepresentativeLeonor Sullivan strove to pass food-stamp program legislation.

Hunger continued for the poor people of the country even after the Great Depression ended, but advocacy to reinstate the food stamp program was generally unsuccessful while the political agenda did not require it. Until 1961 when President John F. Kennedy took office, there were few pilot programs in place to help America’s poor.

Of the program, US Representative Leonor K. Sullivan of Missouri asserted, “…the Department of Agriculture seemed bent on outlining a possible food stamp plan of such scope and magnitude, involving some 25 million persons, as to make the whole idea seem ridiculous and tear food stamp plans to smithereens.”

I Hear About Some People Getting Snap Right Away Or Within A Few Days Of Applying How Is That Possible

Even if the SNAP office cannot do a complete eligibility interview for you on the same day you file your application, you at least must be screened to see if you qualify for what is called “expedited” consideration.

If your household has little or no money and needs help right away, you may qualify for “expedited”SNAP. If you do, you must receive your initial SNAP benefit within five days. You will still have to complete the eligibility process, and supply all the required documentation at a later date.
