If you are between 16-59 years old, you must either work at least 30 hours a week or participate in SNAP Employment and Training, a program under the Texas Workforce Commission. You might be exempt from the work requirement if:

  • you are not physically or mentally fit to work, or participating in drug/alcohol addiction treatment program
  • you are responsible for care of a child under age 6 or a person with a disability
  • you are a student enrolled in school, college or a work training program
  • you already registered for employment services under TANF
  • you have applied for or are receiving unemployment compensation
  • you are three to nine months pregnant

Citizenship And Residency Requirements For Snap In Texas

One of the most basic food stamp qualifications in Texas relates to the fact that all applicants must be U.S. citizens or legal residents. Keep in mind that not all legal aliens are accepted into this program, even if they meet the qualifications for other government programs. However, many are eligible.

If you have a mix of legal and non-legal residents in your household, you can still apply for benefits. Because SNAP eligibility is limited to applicants who have a legal status in the U.S., you will simply receive a different amount of assistance based on the number of household members who are deemed eligible. For example, it is possible for the children of non-citizens to receive benefits, even if their parents do not meet the requirements.

What Is Texas Food Stamps

  • Three-person units are awarded $504 or less.
  • Families with four members may only collect $640 or less.
  • Five-member households can only receive up to $760.

In addition, households with more than five members may also receive SNAP benefits. To calculate these benefit amounts, petitioners who fall into these categories must add an additional $144 for each member of the household to the maximum benefit total of the program.

Eligible Food Items Under Snap

As per USDA rules, households can use SNAP benefits to purchase:

  • Foods for the household to eat, such as:
  • fruits and vegetables
  • Food items that are consumable in the store
  • Vitamins and medicines
  • Soft drinks, candy, cookies, snack crackers, and ice cream are classified as food items and are therefore eligible items. Seafood, steak, and bakery cakes are also food items and are therefore eligible items.

    Energy drinks which have a nutrition facts label are eligible foods, but energy drinks which have a supplement facts label are classified by the FDA as supplements, and are therefore not eligible.

    Live animals and birds may not be purchased but live fish and shellfish are eligible foods. Pumpkins are eligible, but inedible gourds and solely ornamental pumpkins are not.

    Gift baskets containing both food and non-food items “are not eligible for purchase with SNAP benefits if the value of the non-food items exceeds 50 percent of the purchase price. Items such as birthday and other special occasion cakes are eligible as long as the value of non-edible decorations does not exceed 50 percent of the price.”

    Governor Says State Extending Emergency Food Stamp Benefits For Texans

    WACO, Texas – Texas Governor Greg Abbott Friday announced the Texas Health and Human Services Commission is providing approximately $286 million in emergency Supplemental Nutrition Assistance Program food benefits to Texans for the month of September.

    The decision to extend the emergency benefits comes as the state experiences a surge in COVID-19 cases.

    Millions of Texans have looked to Emergency SNAP benefits to keep food at home throughout the pandemic, and I am happy to work alongside HHSC to continue providing this critical resource to those who need it, said Governor Abbott.

    HHSC received federal approval from the U.S. Department of Agriculture to extend the maximum, allowable amount of SNAP benefits to recipients based on family size.

    All households that qualify for SNAP benefits will receive a minimum of $95 in emergency allotments.

    As we continue to navigate through the pandemic, we are pleased to provide this additional support to ensure Texans will be able to keep food on their table for themselves and their families, said Texas HHS Access and Eligibility Services Deputy Executive Commissioner Wayne Salter.

    Abbotts office said the emergency September allotments are in addition to the more than $3.2 billion in benefits previously provided to Texans since April 2020.

    Recipients will also continue to receive a 15 percent increase in their total benefits, which will continue monthly until September 2021.

    Senator Elizabeth Warren and Congressman Al Lawson introduced The College Student Hunger Act of 2019 on July 17, 2019, in an attempt to extend SNAP benefits for college students in need. The idea was to include both Pell Grant-eligible students and independent students. Warren and Lawson both believe that students have a right to both food and education, and the goal was to alleviate financial tension. This bill has been endorsed by several organizations including Bread for the World.
