Finally, receipt of stimulus funds under the CARES Act will not be considered in assessing public charges.

What Benefits Can An Undocumented Worker Receive

While many U.S. citizens can count on food stamps, unemployment assistance and the stimulus check individuals who are undocumented immigrants. And if an individual cannot provide evidence of citizenship, then they do not qualify for state assistance, according to García.

Alvarez, a lawyer for Legal Aid at Work, said undocumented immigrants in California qualify for two types of benefits that come from the state.

The first type of benefit is provided by the State Disability Insurance , which can be solicited by individuals who are either sick with the coronavirus or are in quarantine ordered by a medical professional, Alvarez said.

What that benefit does is replace from 60% to 70% of the regular wage of that person, Alvarez said. They base it on a basic period of approximately 12 or 18 months.

The second benefit applies to someone taking care of a family member who has coronavirus or any other serious medical condition, then the person applicable can solicit for permission for Paid Family Leave.

Alvarez states that undocumented immigrants can solicit benefits from the Employment Development Department through a paper form and fill out to their ability leaving the social security area blank.

Who Is A Qualified Immigrant

Qualified immigrants are:

  • Lawful permanent residents , including Amerasian immigrants or
  • Refugees, asylees, persons granted withholding of deportation, conditional entry , or paroled for at least one year or
  • Cuban/Haitian entrants or
  • Adults or minors subject to severe trafficking, or their spouse/parents/children or
  • Certain battered spouses and children.
  • Iraqi and Afghan Special Immigrants

Be forewarned

There is a brief period of SNAP eligibility for Iraqis and Afghanis employed by the United States, as translators and interpreters, with Special Immigrant Visas who can qualify for CalFresh benefits. The time period for eligibility is six to eight months depending on eligibility criteria.

People in the United States under the Deferred Action for Childhood Arrivals program are not eligible for CalFresh or CFAP.

Qualified immigrants must also meet ONE of the following conditions to receive regular CalFresh benefits:

  • Have been in the United States as a qualified immigrant for five years or
  • Be under 18 or
  • Be receiving disability-related assistance or
  • Have one of the following immigration statuses:
  • Refugee
  • Amerasian
  • Lawful permanent resident who used to have one of the above immigration statuses or
  • Be a veteran of the United States military, or a member of the United States military, or a spouse or child of a person in the military or a veteran or
  • Be a noncitizen national .
