To qualify for the Pennsylvania Food Stamps and EBT Card benefits, you must:

  • Be a U.S. Citizen or Legal Non-Citizen
  • Live in the state of Pennsylvania
  • Meet the SNAP Income Limit

In addition to the eligibility requirements listed above, your household must also meet the three income and resources tests.

Income is the most important requirement when it comes to qualifying for Pennsylvania food stamps.

The three tests include your households gross monthly income, net income, and assets.

Gross Monthly Income is your households total income before any deductions. This includes money earned from work and other assistance such as unemployment, Social Security and child support.

Net Income is your households total income after all allowable deductions.

Assets is your households total resources that are considered available to purchase food, such as bank accounts and cash.

Which Non Citizens Can Get Food Stamps

Below is a general list of qualified immigrants who can potentially receive food stamps:

  • Lawful permanent residents who have lived in the U.S. for 5 years in qualified status. In states like California, Connecticut, Main, Minnesota, and Washington, you do not have to wait 5 years to receive SNAP benefits.
  • Refugees accepted by the U.S. who have been given withholding of deportation, conditional entry, or paroled into the country for at least a year.
  • Immigrants from Cuba or Hati.
  • Battered women and children with a pending or approved 1.) self-petition for an immigrant visa, 2.) an immigrant visa filed for a spouse or child by a U.S. citizen, 3.) an application for cancellation of deportation.
  • Victims of trafficking who have obtained the T visa.
  • Senior citizens born before August 22, 1931, who lawfully lived in the U.S. on August 22, 1996.
  • Lawful permanent residents who have a connection to the U.S. military.

Editors Note:If you are in the process of applying for citizenship you are encouraged to speak with your lawyer before applying for food stamps. At the moment food stamps are no longer considered under the Public Charge, but things can change. Your immigration attorney will be able to best advise you if applying for SNAP benefits is a good idea.

What Is An Abawd Required To Do

To maintain eligibility for SNAP benefits for more than three months in the 36-month period that started January 1, 2019, an ABAWD must complete and document participation in one of the following each month:

  • Work for at least 80 hours per month
  • Participate in a qualifying work/training program approved by the social services district for at least 80 hours per month
  • Comply with a Work Experience Program assignment for the number of hours per month equal to the SNAP grant divided by the higher of the federal or State minimum wage.
  • Participate in an employment and training program for veterans operated by the Department of Labor or the Department of Veteranââ¬â¢s Affairs for at least 80 hours per month.
  • Participate in a program under the Workforce Innovation and Opportunity Act or Trade Act which may include job search, job readiness, occupational skills training and education activities for at least 80 hours a month or
  • Participate in a combination of work or qualifying work programs for at least 80 hours a month.

Note: New York State is currently operating under a federal waiver of the ABAWD time limit in all areas of the State for the period October 1, 2020 through September 30, 2022 so no ABAWD is subject to the time limit requirement during this period.

What Does Snap Consider As An Eligible College/school

SNAP considers the following as eligible schools:

  • Anyone enrolled in a regular curriculum at a university or college.
  • If you attend a business or trade school or
  • If you go to a vocational school that requires a high school education.

Being enrolled half-time at any of these types of schools is a requirement to get SNAP benefits as a student.

New Public Charge Rule By Trump Administration

How Can I Find Out Where To Apply For Snap

Probably, the quickest way is to apply for SNAP online at myBenefits.ny.gov or if you live in New York City. After your application is filed, the SNAP office will review your information, conduct an interview, and determine your household’s eligibility for SNAP.

You may also apply in person, by mail, or fax. To find the address and phone number of the SNAP office nearest you, call the toll-free New York State Temporary Assistance Hotline at 1-800-342-3009. By following the prompts on the automated caller response system, you can find the address and phone number of the SNAP office for where you live.

You can also choose the option to speak to an operator, and they will give you the information about the SNAP office for where you live. You may also find a listing for your county Department of Social Services in the blue pages of government office listings in your phone book.     What If I Want To Opt Out Of Receiving Calfresh Benefits For Myself And Just Apply For Others In My Household

    Any non-citizen can opt out of receiving CalFresh benefits if they choose. If you would like to opt out and apply only for others in your household, leave the Social Security number question blank on the application. Be sure to tell the caseworker that you are a non-citizen and that you dont want benefits for yourself. You can do the same for any other non-citizens in the household who do not want to receive benefits.

    Anyone who opts out of receiving benefits should still be listed on the application and should still provide income and expense information so that the county can determine whether or not your household meets other CalFresh requirements.

    Some immigrants, like U Visa applicants and survivors of human trafficking, may be eligible for CalFresh before they get Social Security numbers. Be sure to tell our staff that they want to be included.

    If you Able-Bodied Adult Without Dependents meaning you are an individual age 18 through 49 who does not live with a child under 18 and is fit for work then you must comply with the work requirements to continue receiving food stamps.

    The rules state that ABAWDs can only get food stamp benefits for 3 months in 3 years unless they meet certain special work requirements or are excused.

    However, there are exceptions to the 3-month limit. If you are an ABAWD, you may be exempted from the time limit work requirements if you:

    • Work an average of at least 20 hours per week each month in unsubsidizedemployment or
    • Participate 20 hours per week in an approved employment and training program or
    • Participate in community service by volunteering at a nonprofit organization.

    You may be exempt from meeting work requirements if you meet any of the following

    criteria:

    • Are physically or mentally unable to work 20 hours a week.
    • Receive Retirement, Survivors and Disability Insurance due to disability or blindness, or receives Supplemental Security Income or State Disability Assistance.
    • Receive or are an applicant for unemployment benefits.
    • Participate in a drug or alcohol treatment and rehabilitation program.
    • Attend training or college at least half-time and meet the student eligibility criteria to receive food assistance.
    • Care for an incapacitated person or a child under age 6.
    • Are pregnant.
    • Are a victim of domestic violence.
    • Reside in a household with a child under age 18.

    New “public charge” rules issued by the Trump administration expand the list of programs that are considered welfare, receipt of which may prevent a prospective immigrant from receiving lawful permanent residence . Analysis by the Center for Immigration Studies of the Census Bureau’s Survey of Income and Program Participation shows welfare use by households headed by non-citizens is very high. The desire to reduce these rates among future immigrants is the primary justification for the rule change. Immigrant advocacy groups are right to worry that the high welfare use of non-citizens may impact the ability of some to receive green cards, though the actual impacts of the rules are unclear because they do not include all the benefits non-citizens receive on behalf of their children and many welfare programs are not included in the new rules. As welfare participation varies dramatically by education level, significantly reducing future welfare use rates would require public charge rules that take into consideration education levels and resulting income and likely welfare use.

    The ACA significantly changed the policies governing Medicaid eligibility determinations and renewals. For many Medicaid households, including children, parents, and newly eligible adults, states must now use Modified Adjusted Gross Income , which relies on income tax rules to define household size and countable income.
