In general, most students, ages 18 through 49, who are enrolled at least half-time in an institution of higher education are not eligible for SNAP benefits in New York.

However, there are numerous exceptions to this rule:

Students, ages 18 through 49, who are enrolled at least half-time in an institution of higher education, may be able to get SNAP if they:

  • Receive public assistance benefits or
  • Receive unemployment insurance or
  • Take part in a state or federally-financed work-study program orWork on average 20 hours per week or
  • Is a single parent enrolled full time and taking care of a dependent household member under the age of 12 or
  • Take care of a dependent household member under the age of 6 or
  • Take care of a dependent household member age 6 through 11 and do not have adequate child care to enable them to work a minimum of 20 hours per week
  • Assigned to or placed in college or certain other schools as part of certain job or employment training programs or
  • Enrolled in qualifying career and technical education programs of study.

Each institution of higher education determines what is considered half-time enrollment.

Additionally, students who meet any of the exceptions above must also meet all other SNAP eligibility requirements in New York to receive benefits.

There are three ways to apply for cash assistance and/or SNAP/Food Stamps:

Generally, all households must meet Gross Income limits in order to be eligible for SNAP in New York.

However, some households must also meet Net Income limits to be eligible.

Gross income means a households total, non-excluded income, before any deductions have been made, such as taxes or other withholdings.

The Families First Coronavirus Response Act authorized an Emergency Allotments addressing food insecurity to SNAP households during the pandemic. SNAP households are eligible to receive an EA supplemental benefit in the amount that will bring them up to the maximum SNAP monthly benefit level for their household size or a supplement of $95whichever amount is greater.Benefits have been issued every month since March 2020.

Case Example

A household size of 3 receives $209 in SNAP benefits. The maximum amount of SNAP benefits a household size of 3 can receive is $616. Through the EA, this household will receive an extra $407 in SNAP benefits. A household size of 2 receives $370 in SNAP benefits. The maximum of SNAP for a household size of 2 is $430. The EA supplement will be calculated at $95 rather than $60.

Requesting An Account Closure

SNAP recipients are free to request an account closure at any time if they no longer want to receive benefits. Call your local social services agency and inform them of your wishes or mail a request. Don’t forget to include your name, address, account number and date. If you have any questions before you take this step, contact the SNAP information hotline at 800-221-5689. Temporary Student Expansion For Snap

The Consolidated Appropriations Act, 2021, temporarily expanded SNAP eligibility for students of higher education. College student eligibility for SNAP has been expanded in two ways:

  • Eligible for a state or federal work study program, even if not enrolled, OR
  • Have an Expected Family Contribution of $0 on their Free Application for Federal Student Aid for the current academic year.

This expansion will continue for the duration of the COVID public health emergency and until 30 days after the federal public health emergency declaration is lifted,

Students who are granted a temporary exemption and meet all other SNAP eligibility rules, will remain eligible until their next recertification even if the COVID-19 emergency declaration ends during their certification period.

How Long Before The Snap Benefits Office Make Its Decision

The food stamp office must make a decision on your application within 30 days of the date you submit it.

They will usually issue SNAP benefits going back to the date of your application.

However, if you or someone in your household causes a delay, your application can be held open another 30 days.

In this case, you will not get back benefits. If you delay completing the application for more than 60 days, your application can be denied.

Removing A Household Member

When a member of the household leaves home, you must report that change to your local social services agency. Perhaps an adult child finished college and got a job out of state, or your elderly parent needs full-time care in a nursing home. Whatever the reason, removing that individual from your food stamp account reduces the number of household members. The family will now need to meet income guidelines for one less person in the home. Often this puts a household above the required income limits for SNAP, which results in the social worker closing out the case. To report a change, call your case worker directly or mail the agency your request. Aid continuing means your benefits should continue unchanged until the hearing decision is made.

Because of COVID-19, most hearings are only being held by telephone, not in person. You have the right to decline a telephone hearing and ask that it be rescheduled in person at a future date.

Another option is to simply let your benefits end naturally, with no action on your part. There are two situations when this can occur. First, you may be close to a re-certification and you want to forgo the re-certification interview and the associated paperwork. Failure to supply the required information results in the agency closing out your food stamp account. Second, you can report changes that would put you over the maximum income and resource limit, so that when the social worker reviews the new information, she will adjust the amounts in the system. The system then determines that you are no longer eligible for benefits, and you will receive a notice of account closure in the mail.
