The 2002 Farm Bill restores SNAP eligibility to most legal immigrants that:
- Have lived in the country for 5 years or
- Are receiving disability-related assistance or benefits or
- Have children under 18
Certain non-citizens, such as those admitted for humanitarian reasons and those admitted for permanent residence, may also be eligible for SNAP. Eligible household members can get SNAP benefits even if there are other members of the household that are not eligible.
Oregon Food Stamps Requirements
There are specific food stamps requirements in Oregon that claimants need to meet before they can enroll to receive program benefits. For example, claimants must be OR residents. Even though SNAP is available throughout the country, petitioners are only able to enroll in food stamps in the states where they live. Additionally, claimants must be sure that they meet the states income requirements for food stamps, which are determined based on how large the applicants families are.
Furthermore, claimants need to be aware that there are specific food stamps eligibility requirements they may need to meet depending on their ages. For example, college students, adults without dependents and elderly individuals all have specific enrollment requirements. These prerequisites may vary depending on what counties petitioners live in or how much they work.
How Do I Apply For Snap
There are several options for applying. Only one member of the households needs to apply for the total household, but everyone living in the household needs to be included on the application along with their income. Most states provide an online application to start the process. See the States website section for a link to your states website. If your state does not provide an online application or you do not have access to a computer, you can go to your local state or county office to apply.
As part of the application process, you will need to go to your local state or county office for a face-to-face interview. If you are not able to go to the local office or apply online, you can designate an authorized representative. This is someone you give authority to represent you. You have to designate the person in writing to be official. This person can be a friend or relative.
The entire process generally involves filling out an application, going in for a face-to-face interview, and providing verifications for needed information such as income, residency, and expenses. If because of age or disability, an applicant is unable to go to the office and cannot appoint a representative, the interview may be waived at the discretion of the local office. However, if the interview is waived, the applicant will have to have a phone interview or consent to a home visit instead.

Eligible Food Items Under Snap
As per USDA rules, households can use SNAP benefits to purchase:
- Foods for the household to eat, such as:
- fruits and vegetables
Soft drinks, candy, cookies, snack crackers, and ice cream are classified as food items and are therefore eligible items. Seafood, steak, and bakery cakes are also food items and are therefore eligible items.
Energy drinks which have a nutrition facts label are eligible foods, but energy drinks which have a supplement facts label are classified by the FDA as supplements, and are therefore not eligible.
Live animals and birds may not be purchased but live fish and shellfish are eligible foods. Pumpkins are eligible, but inedible gourds and solely ornamental pumpkins are not.
Gift baskets containing both food and non-food items “are not eligible for purchase with SNAP benefits if the value of the non-food items exceeds 50 percent of the purchase price. Items such as birthday and other special occasion cakes are eligible as long as the value of non-edible decorations does not exceed 50 percent of the price.”

How To Appeal An Oregon Food Stamps Denial

Do you want to apply for SNAP benefits in person? If so, contact a local office for in-person application instructions and business hours. If you are applying for a family or as a single adult without a disability, you must visit a local DHS self-sufficiency office. If you are elderly or have a disability, you may contact a seniors and people with disabilities office. These offices may provide you with additional assistance as needed.

When you register for your SNAP benefits, your caseworker will determine your qualifications based on your earnings, your household members, and the number of cashable assets, according to USDA. An asset that is considered cashable includes cars that members of the household owns. Although USDA sets the principles and guidelines for the worth of the asset, states are given the liberty to essentially determine to either execute these regulations or disregard them.
According to USDAâs vehicle policy, up to approximately $4,650 of a vehicleâs value is excluded from assets. For example, this means that if your vehicleâs worth is $5,000, only $350 of that total is considered to be a resource.
Yet there have been some instances where the vehicles entire worth has been exempt, including if you use the vehicle to reside in if the car is used to help make money, if you use it to transfer a disabled family member, or if the equity value is $1,500 or less.

This fall, individuals and families in Columbia County, across Oregon and the nation who depend on food stamp assistance will see what the Biden Administration calls a significant and permanent increase in benefits.
It is reportedly the largest single increase in the food stamp system’s history, which now operates as the Supplemental Nutrition Assistance Program .
Impact in Oregon
This change will increase SNAP benefits distributed in Oregon by $337 million. For SNAP households this change on average will be about $36 more in money to buy food per person.
Oregon Department of Human Services Press Secretary Jake Sunderland said Biden Administration made the announcement Monday, Aug. 16, and his department is still analyzing the changes and what they will mean to SNAP in Oregon.
“According to federal government, this change will increase SNAP benefits distributed in Oregon by $337 million,” Sunderland said. “For SNAP households this change on average will be about $36 more in money to buy food per person or about $1.20 per day.”
The change in benefits takes effect Oct. 1.
Currently, due to the COVID-19 pandemic, most SNAP households are temporarily receiving the maximum benefit amount for their household size, according to Sunderland.
“These are called emergency allotments and we have been providing these emergency allotments since March 2020,” he said.
