Immigrant Status And Eligibility

The 2002 Farm Bill restores SNAP eligibility to most legal immigrants that:

  • Have lived in the country for 5 years or
  • Are receiving disability-related assistance or benefits or
  • Have children under 18

Certain non-citizens, such as those admitted for humanitarian reasons and those admitted for permanent residence, may also be eligible for SNAP. Eligible household members can get SNAP benefits even if there are other members of the household that are not eligible.

What Are Deductions And How Do They Affect Snap Eligibility

There are seven allowable deductions that you can consider when determining your net pay. To figure out your net income, you have to figure out which allowable deductions apply to your situations and deduct them from your gross income. The difference is your net income.

Each state outlines employment requirements as part of SNAP eligibility. These requirements include:

  • Registering for work – some states will require you to provide proof that you are actively applying for work on a weekly basis.
  • Not voluntarily quitting your job If you are unemployed, you need to prove that it was not your choice.
  • Not purposely reducing your hours If your hours are cut making you income eligible, you will need to prove that the cut in hours was beyond your control.
  • Taking a job if offered
  • Participating in state-offered employment and training programs.

SNAP benefits will be discontinued if any of these employment requirements are not followed. There are people exempt from the employment requirements. This includes children, seniors, pregnant women, and individuals that are exempt from working for health reasons.

Employment requirements apply to applicants determined to be Able-Bodied Adults without Dependents . Under the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, ABAWDs are limited to 3 months of SNAP benefits over a 36-month period unless they are doing at least one of the following:

Receiving Your Snap Benefits: Lone Star Card

When you qualify for SNAP, you will be receiving benefits through Lone Star Card. This is a standard plastic card, as in the case of debit cards. The card is used just like a debit card. You will have the money in your account on due date and you can purchase food items with it, using it like a debit card.

The United States Department of Agriculture provides SNAP benefits. USDA will load your card with your monthly amount of SNAP benefits, each month. You can use this money on stores where regular debit card works.

If you qualify and receive a Lone Star Card, it is your responsibility to use it with care. No one else can use your card since it is illegal to allow someone else to use your benefits. If you are in a situation where you’ll need someone else to use your card for you, you will have to ask for a second card. You can then give the second card to someone you trust. The money spent from that card will be deducted from your primary card.

In order to start using your Lone Star Card, you will have to sign at the back of your card after you receive it. You will also need to register it in order to use it. You can call 1 800 777 7328 to register your card. You will then choose a PIN for your card.

If you opt to pick up your card at HHSC benefits office instead of getting it in mail, you won’t have to register it. When you are handed over the card at the office, it is registered at spot.

Applying for emergency food stamps is exactly the same as applying for regular food stamps. It comes down to essentially 5 different ways to apply which are:

  • Foods for the household to eat, such as:
  • fruits and vegetables
  • Food items that are consumable in the store
  • Vitamins and medicines
  • Soft drinks, candy, cookies, snack crackers, and ice cream are classified as food items and are therefore eligible items. Seafood, steak, and bakery cakes are also food items and are therefore eligible items.

    Energy drinks which have a nutrition facts label are eligible foods, but energy drinks which have a supplement facts label are classified by the FDA as supplements, and are therefore not eligible.

    Live animals and birds may not be purchased but live fish and shellfish are eligible foods. Pumpkins are eligible, but inedible gourds and solely ornamental pumpkins are not.

    Gift baskets containing both food and non-food items “are not eligible for purchase with SNAP benefits if the value of the non-food items exceeds 50 percent of the purchase price. Items such as birthday and other special occasion cakes are eligible as long as the value of non-edible decorations does not exceed 50 percent of the price.”

    Special Rules For Elderly Or Disabled

    There are several exceptions and exemptions to the SNAP procedures if a household member is elderly or disabled. A person is considered elderly for SNAP purposes if they are 60 years or older.

    A person is considered disabled for SNAP purposes if they are:

    • Receiving federal disability or blindness payments under the Social Security Act or SSI.
    • Receiving a disability retirement benefit from a governmental agency because of a disability considered permanent under the Social Security Act.
    • Receiving an annuity under the Railroad Retirement Act while being eligible for Medicare and considered disabled under the SSI rules.
    • A veteran who is totally disabled, permanently housebound or in need of regular aid or attendance.
    • A surviving spouse or child or a veteran who is receiving VA benefits and is considered to be permanently disabled.

    The SNAP program is one of several programs offering financial help for senior citizens.

    If you printed a paper food stamp application, you can submit it to an office in person rather than mailing it. It is also possible to complete the entire application in person. To do so, you will need to find an HHSC Community Partner, which is a local organization that provides HHSC services.
