Benefit Programs That Depend On Immigration Status

For other programs, your eligibility depends on whether you are a Qualified Immigrant.

Some of these programs include:

Qualified Immigrant is a term that is defined by US immigration law. Qualified Immigrants include:

  • Lawful Permanent Residents ,
  • Immigrants who have been paroled into the US for 1 year or more,
  • Immigrants whose deportation or removal from the US has been withheld,
  • Immigrants granted conditional entry,
  • Immigrants whose children have suffered domestic abuse,
  • Immigrant children who have suffered domestic abuse, or
  • Immigrants who have been granted nonimmigrant status under US law.

To be eligible for most of these programs, you have to be a Qualified Immigrant for at least 5 years. But for some of them, certain Qualified Immigrants are eligible right away.

SNAP benefits for immigrants

You may be immediately eligible for the SNAP program if you are a member of one of the following groups:

  • US veterans or persons on active duty and their families,
  • A child of a Qualified Immigrant who is under 18 years old,
  • Refugees,
  • Immigrants who have had their deportations withheld,
  • Amerasian immigrants,
  • Native Americans born in a different country,
  • Members of the Hmong or Highland Laotian tribes,
  • Immigrants born on or before August 22, 1931, and who lawfully lived in the United States on August 22, 1996,
  • LPRs who are blind or disabled, or
  • LPRs who are veterans or active duty members of the US military and their dependents.

What Happens After I Submit My Application

After you submit your application, our office may reach out to you to schedule an interview. This interview is required to review the information you provided on your application. If you are missing any documents, our staff will let you know what to provide.

Know your rights! If a non-citizen in your home is not requesting benefits, we are not allowed to ask for proof of their immigration status. For example, a green card holder who is not applying for benefits for themselves should not be asked to provide their green card information.

Will Mdhhs Share My Information With Immigration

The Michigan Department of Health and Human Services is in charge of FAP for Michigan. Generally, MDHHS is not allowed to share any information with U.S. immigration authorities about non-citizen applicants.

MDHHS workers may share information with the U.S. Citizenship and Immigration Services when there is a final order of deportation against an applicant. The same is true if USCIS or an immigration judge determines an applicant is unlawfully present.

DACA recipients cannot receive any federal benefits, like Social Security, college financial aid, or food stamps. DACA recipients are required to pay federal income taxes. DACA recipients can apply for drivers licenses in some states. The licenses are marked that they cannot be used for federal purposes, like voting.

Your personal information is protected and only used to determine your eligibility for benefits. Federal and state laws protect the privacy of people who apply for and receive CalFresh. If you are applying for benefits only for another person in your family or household, you do not have to share your immigration status with CalFresh. Our office may share information with other government agencies only to determine your eligibility for benefits, with limited exceptions.

Can Illegal Immigrants Get Social Security Or Access To Federal Health Programs

Though many pay into the system, illegal immigrants are not eligible for Social Security retirement or disability payments. Despite undocumented immigrants contributing about $12 billion per year to the Social Security trust fund, most cannot access this money.

According to EconoFact.org, illegal immigrants also cannot access most federal health programs. These programs include non-emergency Medicaid, the Childrens Health Insurance Program , and Medicare. In addition, illegal immigrants arent eligible for insurance subsidies under the Affordable Care Act and prohibited from ACA-based insurance exchanges.

Verification Of Immigration Status

The CalFresh office is required to verify the immigration status of individuals who are applying for CalFresh benefits, but may not require applicants to provide information about the citizenship or immigration status of any non-applicant. The CalFresh office may not deny benefits to an applicant because a non-applicant family or household member has not disclosed her citizenship or immigrant status.

Yes, and here are a few helpful points to consider:

First, undocumented parents can apply for children who have citizenship or eligible immigrant status.

Additionally, CalFresh does not share information with immigration enforcement officials.You can tell your caseworker that a non-citizen in your family does not want to be considered for benefits.

Also, once you do that, your caseworker is not permitted to ask for proof of their immigration status.

Furthermore, you do not have to provide proof of immigration status for anyone who is not applying for benefits for themselves.

Finally, benefits used by children or other household members dont negatively impact undocumented family members.

However, it is important that you are honest about your immigration situation when applying for CalFresh.
