Benefit Programs That Depend On Immigration Status
For other programs, your eligibility depends on whether you are a Qualified Immigrant.
Some of these programs include:
Qualified Immigrant is a term that is defined by US immigration law. Qualified Immigrants include:
- Lawful Permanent Residents ,
- Immigrants who have been paroled into the US for 1 year or more,
- Immigrants whose deportation or removal from the US has been withheld,
- Immigrants granted conditional entry,
- Immigrants whose children have suffered domestic abuse,
- Immigrant children who have suffered domestic abuse, or
- Immigrants who have been granted nonimmigrant status under US law.
To be eligible for most of these programs, you have to be a Qualified Immigrant for at least 5 years. But for some of them, certain Qualified Immigrants are eligible right away.
SNAP benefits for immigrants
You may be immediately eligible for the SNAP program if you are a member of one of the following groups:
- US veterans or persons on active duty and their families,
- A child of a Qualified Immigrant who is under 18 years old,
- Refugees,
- Immigrants who have had their deportations withheld,
- Amerasian immigrants,
- Native Americans born in a different country,
- Members of the Hmong or Highland Laotian tribes,
- Immigrants born on or before August 22, 1931, and who lawfully lived in the United States on August 22, 1996,
- LPRs who are blind or disabled, or
- LPRs who are veterans or active duty members of the US military and their dependents.

What Happens After I Submit My Application
After you submit your application, our office may reach out to you to schedule an interview. This interview is required to review the information you provided on your application. If you are missing any documents, our staff will let you know what to provide.
Know your rights! If a non-citizen in your home is not requesting benefits, we are not allowed to ask for proof of their immigration status. For example, a green card holder who is not applying for benefits for themselves should not be asked to provide their green card information.

Will Mdhhs Share My Information With Immigration
The Michigan Department of Health and Human Services is in charge of FAP for Michigan. Generally, MDHHS is not allowed to share any information with U.S. immigration authorities about non-citizen applicants.
MDHHS workers may share information with the U.S. Citizenship and Immigration Services when there is a final order of deportation against an applicant. The same is true if USCIS or an immigration judge determines an applicant is unlawfully present.
The Food Stamp Program Rewards Households With Illegal Aliens
- Four legals, with income of $36,000 a year NOT eligible for Food Stamps.
Three legals + one illegal with household “income” calculated at $27,000 a year – BINGO eligible for Food Stamps.
In addition to the question of eligibility vs. non-eligibility for Food Stamps of these mixed households, there is the question of the size of the monthly grant. According to an article in The Kansas Reporter the matter is before the Kansas Department of Social and Rehabilitation Services , and one of its executives was quoted as saying:
As a result an ineligible household of four, on average, could bring in $908 more in income and qualify for the same food stamp benefits, Michelle Schroeder, SRS director of public policy told House Appropriations Committee members.

Can I Get Food Stamps With Daca
DACA recipients cannot receive any federal benefits, like Social Security, college financial aid, or food stamps. DACA recipients are required to pay federal income taxes. DACA recipients can apply for drivers licenses in some states. The licenses are marked that they cannot be used for federal purposes, like voting.
How Will My Personal Information Be Used
Your personal information is protected and only used to determine your eligibility for benefits. Federal and state laws protect the privacy of people who apply for and receive CalFresh. If you are applying for benefits only for another person in your family or household, you do not have to share your immigration status with CalFresh. Our office may share information with other government agencies only to determine your eligibility for benefits, with limited exceptions.

Can Illegal Immigrants Get Social Security Or Access To Federal Health Programs
Though many pay into the system, illegal immigrants are not eligible for Social Security retirement or disability payments. Despite undocumented immigrants contributing about $12 billion per year to the Social Security trust fund, most cannot access this money.
According to EconoFact.org, illegal immigrants also cannot access most federal health programs. These programs include non-emergency Medicaid, the Childrens Health Insurance Program , and Medicare. In addition, illegal immigrants arent eligible for insurance subsidies under the Affordable Care Act and prohibited from ACA-based insurance exchanges.

Are undocumented immigrants eligible for federal public benefit programs?
Generally no. Undocumented immigrants, including DACA holders, are ineligible to receive most federal public benefits, including means-tested benefits such as Supplemental Nutrition Assistance Program , regular Medicaid, Supplemental Security Income , and Temporary Assistance for Needy Families . Undocumented immigrants are ineligible for health care subsidies under the Affordable Care Act and are prohibited from purchasing unsubsidized health coverage on ACA exchanges.
Undocumented immigrants may be eligible for a handful of benefits that are deemed necessary to protect life or guarantee safety in dire situations, such as emergency Medicaid, access to treatment in hospital emergency rooms, or access to healthcare and nutrition programs under the Special Supplemental Nutrition Program for Women, Infants, and Children .
Are legal immigrants eligible for federal public benefit programs?
LPRs are eligible to apply for Medicare and Public/Section 8 Housing as well, as long as the five-year bar is fulfilled. For LPRs to become eligible for Social Security benefits for both retirement and disability, they are required to have completed 40 quarters of work in addition to having maintained LPR status for five years.

Verification Of Immigration Status
The CalFresh office is required to verify the immigration status of individuals who are applying for CalFresh benefits, but may not require applicants to provide information about the citizenship or immigration status of any non-applicant. The CalFresh office may not deny benefits to an applicant because a non-applicant family or household member has not disclosed her citizenship or immigrant status.
If an applicant cannot provide acceptable verification of U.S. citizenship and the household can provide a reasonable explanation for the lack of verification, the CalFresh office must accept a signed statement, under penalty of perjury, from a third party. The sometimes bitter debate revealed a fundamental divide in how advocates, analysts, and policymakers think about welfare for non-citizens. On the one hand, those who support welfare benefits for non-citizens point out that at the time of the 1996 reforms, legal non-citizens enjoyed access to a wide range of welfare benefits. This access was based on the principle that non-citizens come to America to participate in the full range of American social, economic, and political life and that, with modest exceptions, they should be treated like other Americans. The children of non-citizens, the vast majority of whom are American citizens, are especially deserving of the safety net provided by welfare programs. Supporters believe that to deny non-citizens and their children welfare benefits is to leave them outside the protective sphere of social welfare guaranteed to the disabled and destitute by federal and state government policy. Moreover, like other Americans, non-citizens pay taxes, and unlike non-citizens in many other countries, can be drafted in time of war.

Yes, and here are a few helpful points to consider:
First, undocumented parents can apply for children who have citizenship or eligible immigrant status.
Additionally, CalFresh does not share information with immigration enforcement officials.You can tell your caseworker that a non-citizen in your family does not want to be considered for benefits.
Also, once you do that, your caseworker is not permitted to ask for proof of their immigration status.
Furthermore, you do not have to provide proof of immigration status for anyone who is not applying for benefits for themselves.
Finally, benefits used by children or other household members dont negatively impact undocumented family members.
However, it is important that you are honest about your immigration situation when applying for CalFresh.
